Terms and Conditions

 EVENTS/PARTIES Unless prior approval has been granted, we have a strict no events or party policy. If person/persons are not listed on the rental agreement (that will need to be emailed to christie@karinyafarmstay.com.au 7 days prior to checking in), they will not be permitted on the property. Guest/guests can request permission in writing for up to a maximum of 4 guests to visit for a day trip out here to the farm, however they won't be permitted to sleep at the premises.

Many farmers in this area are up before light so please observe quiet times in this rural area – 10pm till 6am. We also keep noise to a minimum during this time because it keeps the animals calm.•

NOISE If you or other guests at the property receive a warning about noise and you fail to comply, you will be asked to leave the property IMMEDIATELY with no refund of monies. If our staff, the police or security guards are called to the property to deal with noise complaints and are required to issue a warning — or we receive complaint/s from the neighbours during or after your stay — you will be charged a fee of between $500 to $1000 for each offence. • For the purposes of this clause noise disruption includes — loud behaviour of any type that disrupts the peace and quiet of others;  intrusive or abusive language; or loud music or any sounds affecting other residents that is audible outside the boundaries of the property.

The Property manager or caretaker will be in the stables and paddocks feeding the animals, every morning between 6.30am and 7.30am and every evening between 7pm and 8pm. For your privacy please be assured, property manager or caretaker will not enter the house paddock or property, unless an emergency arises.• 

Please do not flush anything down the toilet other than human waste and supplied toilet paper, anything else will damage the environ cycle.• 

Please only use the dishwashing detergent tablets and Laundry powder provided, anything else will damage the septic system.• 

For your safety, under no circumstances are guests to enter the paddocks where the livestock (cows, sheep and horses) are. By all means you can go down and pat or feed them over the fence (carrots only for horses, bread for sheep or cows is fine but the horses cannot eat bread) but please do not enter paddocks. • 

Please note, if you have children they must be supervised by an adult at all times. Whilst the paddocks do separate the dam and the house, (so there should be no way a child would be near the dam), we like to let guests know that the fence around the dam has gaps in sections and is not secure or child proof. • 

We are happy for you to use the outdoor pizza fire or have a small fire in the designated cast iron fire pit, but under no circumstances do we permit open bonfires in the paddocks etc. Huge fines from the rural fire services will be issued and you will forfeit your bond. • 

As we are on tank water please do not leave taps running, or hoses/sprinklers on. Due to insufficient rain in the dry seasons, our water tanks can get very low. It can sometimes be up to a 3 day wait at the moment to get the water truck in so please be mindful of your water usage during your stay.• 

Please do not stand on or jump on the grey enviro cycle tanks that are in the grassed area near the clothes line. •

Smoking is not allowed inside this Farm House or on the balconies/pool area and will result in forfeiture of your security deposit. • 

Under no circumstances can motorised vehicles to be used in the on the property/in the paddocks i.e. motorbikes, quad bikes etc. • Please do not climb or swing on the gates, they may become unhinged. • 

Children must be supervised at all times, especially near the animals/near their fences. • 

Do not enter the dam or the paddock near the dam, the dam does not have child proof fencing and is not secure, children must be supervised. • 

As the front gate is always open, the house paddock gate near the BBQ must be closed at all times as our dog, ducks and chooks will walk out onto the road if gate is left open.• 

Please ensure that the property is secured and ensure all doors are locked whenever you leave.• 

Outdoor generator – under no circumstances should guests play with or use generator. This is a very complex unit and needs to be only operated by caretaker or groundskeeper. In the event of a black out, the generator will kick in and begin operating automatically. You do not need to do anything.• 

There is an electric fence located in the front house paddock on the fence that runs along the area where the clothes line is and septic grey tanks in ground are. This fence is live and should not be climbed/touched in anyway or you will receive a very large shock. • 

Children must be supervised at all times when using the pool — it is the guest’s responsibility to ensure that children are not left alone at any time in the pool area. • 

No glassware is to be used in the pool area. You will find many plastic cups/tumblers in the pantry for your use. There are also plastic wine and champagne glasses provided for when drinking in the pool area. • 

You are welcome to scoop leaves off the top of the water with the net, however please don’t try to fiddle with the pool pump or the filter/creepy crawly. The pool filter automatically turns on, on a timer, morning and night. This should be adequate for keeping the pool clean during your stay, however if you feel the pool needs to be vacuumed at any time during your stay please contact the property manager (0410691356) and they will arrange for it to be cleaned. • 

Children (ages 3-8yrs) are welcome to use the playground/cubby house in the adjacent paddock, however please be aware this is a shared area, as it is on the land of caretakers/property manager’s cottage (who also have children who play on this equipment).• 

Please leave our property the way it was when you arrived. Please wash the dishes and clean the kitchen. Put all rubbish in the bins at the front of the property.

Barns, Stables, Sheds:All Barns, Stables and Sheds are not to be unlocked, entered or used in anyway. If the above are unlocked, entered or used you will automatically forfeit your $1500 security bond. 

TERMS & CONDITIONS CONTINUED This Rental Agreement is made between the Owner and their Agents of ‘Karinya’ Farmstay' and the above mentioned Guest(s). • This reservation is for quiet residential vacation accommodations only. Therefore parties, receptions, weddings, events and gatherings of any kind are strictly prohibited. No additional people beyond the maximum occupancy (sleeps 12) or the agreed amount of guests you’ve selected on the website booking, are allowed in the home at any one time, unless disclosed to and agreed upon by the Owner/Agent of the house in writing. • The names of all guests staying at the property must be listed above. If the names of guests in your group change, this must be communicated to the Agent/Owner in writing. • Guest(s) agrees to take the property as-is, sight unseen.• Guest(s) acknowledges that the Owner/Agents retain the right to enter the property for any reason, by giving the Guest(s) at least 12 hours notice.• Quiet hours are from 10 pm until 6 am. Please keep noise to a minimum. Guests use of the property is subject to local noise ordinances. Noise complaints are subject to local law enforcement intervention. Law enforcement intervention will be deemed as a breach of this Agreement and may lead to cancellation of your reservation, eviction from the property or loss of your entire deposit. • The property shall be in the same condition upon departure as at check-in.
• Guest(s) may not sublet or assign this Agreement.• Guest(s) are prohibited to smoke in the house; smoking in Karinya will forfeit your deposit.
• Guest(s) must immediately notify the Agent of any fire or other damage or injury to the house or any person(s) in the house.• Guest(s) shall be responsible for all acts of the family, invitees, employees, or other persons invited onto the property by guest.
• Guest(s) shall be responsible to leave all keys with property manager upon departure.
• Guest(s) shall abide by the House Rules of the Owner/Agent as provided to Guest upon booking.• Guest(s) shall not bring any pets onto the property, unless agreed upon prior to stay.
• Guest(s) understands that the Owner/Agents cannot guarantee that adjacent properties will be free from disturbances and/or not be under construction. Construction on adjacent properties or construction conducted by the State is not reason for termination of this agreement, nor is it a reason for the refund of any monies to Guest(s). • Guest(s) understands that Australia is a tropical climate in which insects, rodents, lizards, spiders and snakes flourish. You may encounter these animals during your stay and understand that the Owner/Agents will make our best effort to minimize your exposure to these animals. Contact with an animal inside or outside of your rental is not reason for termination of this Agreement, nor is it a reason for a refund of your monies. • Guest(s) enter property at their own risk. Guest(s) understands that there are certain risks inherent to persons and property that is located in a rural area with livestock on the property and acknowledges that the Owner would not rent this property unless the Guest(s) accepted these conditions and assume these risks. •Owner/Agents will not be liable for personal property lost due to theft, flood, fire, unforeseen circumstances or natural disasters.• Owner will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services, except as noted in Cancellation Policy with Airbnb or on the Karinya Farmstay website.
 Owner reserves the right to cancel or rescind any rental agreement if it is found that the guests are conducting unlawful or dangerous activities (including entering barns, stables, paddocks), have made any misrepresentation about the nature or size of the group, use of the property or any other misrepresentation, or are in any way in breach of any part of the rental agreement. Daily Cleaning Services are not included, but can be provided upon request for an additional fee. If Guest(s) violates any of these terms above, they will risk losing their entire bond and will be liable for additional damages if the amount exceeds the security deposit amount. 

CANCELLATION POLICY / REFUNDS / SECURITY DEPOSIT CANCELLATIONS:

Any request for cancellation must be in writing. Full refund for cancellations made within 24 hours of booking, if the check-in date is at least 14 days away. 50% of paid prepayments refundable when cancelled 60 days before arrival or earlier. 0 % refundable if cancelled after.

REFUNDS: Refunds will be made only if the property rented becomes unfit for habitation and cannot be repaired or restored to its condition at occupancy within a reasonable time. 

SECURITY DEPOSIT: A Security Deposit of $1500 is required and will be returned within 7 days of the departure date, provided there is no damage to the property. Sand may clog showers and baths. Please rinse off all with the outdoor hose before entering the home. Damage to the plumbing can affect the Security Deposit. 

RELEASE OF LIABILITY & INDEMNIFICATION AGREEMENT In consideration for the right to occupy ‘Karinya Farmstay’, the current occupants acknowledge and agree as follows:
1. Guest(s) agrees to inform any and all people who will be on the property, of terms and conditions, and to monitor compliance with terms and conditions.2. Guest(s) agrees to RELEASE, HOLD HARMLESS, INDEMNIFY AND DEFEND Karinya, the Owners and their agents from ANY AND ALL LIABILITY, CLAIMS AND CAUSES OF ACTION arising out of or connected in anyway with participation in any activities at the property. Guest(s) also agree to cover any costs or expenses, including reasonable attorney’s fees incurred in connection with such claims.
3. Guest(s) acknowledges that the release and indemnity provisions apply to all claims for injury or damage resulting from any cause, including the negligence of any party released herein. Guest(s) further acknowledges that this agreement shall be binding on all family members, guests, including minors, guardians, heirs and any executor or personal representative or beneficiary. 4. Guest(s) agrees that this Agreement should be enforced to the full extent permitted by law. If any section or part of this Agreement is held not to be enforceable under the applicable law, the remainder of the Agreement shall be enforced. The release and indemnification provisions of this Agreement do not apply to reckless or intentional acts, unless such provisions are permitted by the applicable law. 5. This Agreement is subject to the laws of the state of Australia. Any disputes are subject to be settled by binding arbitration in Sydney, Australia according to the rules of the Australian Arbitration Association. The prevailing party in any arbitration or litigation shall be entitled to recover reasonable attorneys fees.6. Guest(s) states that he/she is 18 years of age or older and legally competent to sign this Release of Liability and Indemnification Agreement. I understand that these terms are contractual and not a mere recital. I have signed this document of my own free act.7. Guest(s) agrees to hold owner and agent free and clear of any liability for damage to self or property, resulting from accident, injury, loss of enjoyment resulting from the weather, inoperable appliances or equipment (including barbecue). Please sign here that you have read, understand and agree to all of the above Cancellation Policy, Terms & Conditions and Release of Liability information. Confirmation of reservation occurs upon full execution of this agreement.
